Because we broker business funding, we collect more detailed information than a typical website. Depending on how you interact with us, we may collect:

Contact Information Name, business name, mailing address, phone number, and email address.

Business Information Business type, industry, time in business, monthly revenue, business bank account details, and other information related to your business's financial profile.

Personal and Financial Information Owner name(s), date of birth, Social Security Number (U.S.) or Social Insurance Number (Canada), personal credit information, government-issued identification, and business bank statements submitted as part of an application.

Application and Underwriting Information Information you provide on a pre-qualification form or funding application, including details we use to evaluate your business for funding and to match you with an appropriate lending partner.

Communications Records of calls, texts, emails, and other correspondence between you and Fargo Funding, including consent records for outreach.

Device, Usage, and Cookie Information IP address, browser type, device information, referring URLs, and how you interact with our website, collected automatically through cookies and similar tracking technologies (see Section 4).

All information you submit is provided voluntarily. If you choose not to provide certain information, we may be unable to process your pre-qualification or application.

2. How We Use Your Information

We use the information we collect to:

We do not use your financial or application information for any purpose unrelated to evaluating and fulfilling your funding request without your consent.

3. Consent to Contact by Call, Text, and Email

By submitting a pre-qualification form or funding application, you expressly consent to be contacted by Fargo Funding, and by lenders or funding partners we work with on your behalf, by phone call, SMS/text message, and email, including through the use of automated dialing or messaging technology, regarding your application, funding offers, and related services. This consent applies regardless of whether your number is listed on any federal, state, provincial, or other do-not-call registry.

Message and data rates may apply. Message frequency varies.

You may withdraw this consent at any time:

  • Reply STOP to any text message to opt out of SMS communications
  • Use the unsubscribe link in any marketing email
  • Call or email us at the contact information below to be removed from calling or marketing lists

Withdrawing consent will not affect our ability to contact you regarding an active application or existing funding relationship for servicing purposes, where permitted by law.

Consent to receive calls, texts, or emails is not required as a condition of obtaining funding.

4. Cookies and Tracking Technologies

We and our service providers use cookies, pixels, and similar tracking technologies to operate our website, understand how visitors use it, and support marketing efforts. This may include analytics tools that help us understand website traffic and advertising tools that help us reach relevant audiences.

With Lenders and Funding Partners To evaluate your application and secure a funding offer, we share your application, business, and financial information with the lenders and funding partners in our network best positioned to fund your business. Once shared, each lender or funding partner's use of your information is governed by that partner's own privacy practices, and Fargo Funding is not responsible for a partner's independent handling of your information outside of the funding relationship we facilitate.

With Service Providers We work with third-party service providers who support our operations, such as application processing, identity verification, secure document storage, IT infrastructure, and customer communications. These providers are contractually restricted from using your information for any purpose other than providing services to us.

For Legal and Compliance Reasons We may disclose information to comply with applicable law, regulatory requirements, subpoenas, court orders, or other legal process, or to establish, exercise, or defend legal claims, or to protect the rights, property, or safety of Fargo Funding, our customers, or others.

Business Transfers If Fargo Funding is involved in a merger, acquisition, financing, or sale of business assets, your information may be transferred as part of that transaction, subject to standard confidentiality protections.

Approval and funding terms are determined by our lending partners based on the information provided and their own underwriting criteria. Fargo Funding relies on the accuracy of information you submit and is not responsible for decisions, delays, or outcomes resulting from incomplete, outdated, or inaccurate information provided by you or on your behalf.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Fargo Funding, its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the collection, use, disclosure, or loss of your personal information, even if advised of the possibility of such damages. This limitation does not apply where prohibited by applicable law, including with respect to liability that cannot be limited under U.S. state law or Canadian federal or provincial privacy legislation.

13. Governing Law and Dispute Resolution

This Privacy Policy is governed by the laws of the State of Florida, without regard to conflict-of-law principles, for users located in the United States, and by applicable federal and provincial law for users located in Canada.
